Terms of Service
1. Acceptance
These Terms of Service (“Terms”) are an agreement between you and Titanbyte Technologies (“AskTransit”, “we”, “us”) governing your use of the AskTransit mobile app and this website (together, the “Service”). By using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service. You must be at least 13 years old to use AskTransit.
2. The service
AskTransit helps you plan and navigate public-transit trips using conversational search, schedule data, and real-time information from transit agencies. Transit information — including times, delays, vehicle positions and fare estimates — is provided for convenience and may be incomplete, delayed, or inaccurate. Always allow extra time, follow posted information and agency staff, and use your own judgement, especially for time-sensitive or safety-critical trips. Fare estimates are approximate and are not a guarantee of the fare you'll be charged.
3. Accounts
You can use core features as a guest. To save places and trips or subscribe to Plus, you can create an account using Google or Apple sign-in. You're responsible for activity under your account and for keeping your sign-in secure. You can delete your account at any time in the app.
4. Acceptable use
You agree not to misuse the Service. In particular, don't:
- break the law or infringe others' rights while using it;
- attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service or its data;
- scrape, resell, or redistribute transit data or app content except as permitted by the underlying data licences;
- use the Service to build a competing dataset or product in violation of these Terms or third-party licences.
5. Plus, billing & trials
- Free tier. Core trip planning is free and doesn't require payment.
- AskTransit Plus is an auto-renewing subscription: $3.99/month or $29.99/year (CAD), unlocking the Plus features described in the app. We also offer a one-time $2.99 7-day pass, which does not auto-renew.
- Free trial. New Plus subscriptions include a 7-day free trial. You won't be charged if you cancel before the trial ends; otherwise the subscription begins and renews automatically at the price above until cancelled.
- Billing & cancellation. Payments are handled by Stripe and/or the App Store or Google Play, depending on how you subscribe. You can cancel anytime; cancellation stops future renewals and your Plus access continues until the end of the current paid period. Manage or cancel through the app, your Stripe customer portal, or your app-store subscription settings.
- Taxes. Prices may be shown before tax; applicable GST/HST is added at checkout.
- Refunds. The 7-day pass is a one-time purchase and is generally non-refundable once the pass period begins, except where required by law. Subscription refunds follow the policy of the payment processor you used (Stripe, Apple, or Google).
- Price changes. We may change prices; we'll give notice before a change affects a renewal, and you can cancel if you don't agree.
6. Third-party data
Schedule and real-time data come from transit agencies under their respective open-data licences (for example the TTC, Metrolinx/GO, and municipal transit agencies), and map and street data come from © OpenStreetMap contributors (ODbL). Those agencies and contributors are not responsible for AskTransit, and your use of their data through the Service is also subject to their licences. The Service may link to third-party services (such as rideshare apps or external maps); we're not responsible for those services.
7. Intellectual property
The AskTransit name, logo, app, website, and original content are owned by Titanbyte Technologies and protected by applicable laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own transit needs. Underlying transit and map data remain the property of their respective owners.
8. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We don't warrant that the Service will be uninterrupted, error-free, or that transit information will be accurate or complete. AskTransit is an information tool and is not a transit agency.
9. Limitation of liability
To the fullest extent permitted by law, AskTransit and Titanbyte Technologies will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from missed connections, delays, inaccurate information, or inability to use the Service. Where liability cannot be excluded, our total liability is limited to the amount you paid us (if any) in the 12 months before the claim. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless AskTransit and Titanbyte Technologies from claims arising out of your misuse of the Service or your violation of these Terms or applicable law.
11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Provisions that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) will survive termination.
12. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. Disputes will be subject to the courts located in Ontario, unless applicable law provides otherwise.
13. Changes
We may update these Terms as the Service evolves. We'll update the “last updated” date above and, for material changes, provide a more prominent notice. Continuing to use the Service after changes take effect means you accept the updated Terms.
